integrated water service, canceled acts in self-defense after the intervention of Biviano (Pd)

Note of Councillor of the PD James Biviano:

On February 19, 2010, letter prot. 6546, I submitted a complaint to the town of Lipari, alderman Local Authorities of the Sicilian Region and the Prefect of Messina in which I pointed out the illegality of the Council Resolution of 08.06.2009 # 70 "Race for the concession of the water service the City of Lipari "as the vice of the legitimacy of incompetence Deliberative Body.
In essence, the City Administration had launched a tender to outsource the entire water service (billing, management, maintenance, recovery plans, estimates of demand and expenditure, etc.). And not, therefore, the only network management and maintenance, but not taking any administrative measure taken by the City Council.
Law (art. 32 L. 142/90), in fact, provides that the decision to outsource the provision of any public service must necessarily be cleared by the summit, what is the Municipal Council in the organization (in fact defined by the same rules "organ for policy and political-administrative control").
After repeated warnings, written and verbal, sent to the Mayor of Lipari, I received today a memorandum of understanding and in charge of water, Geom. Alessandra Dal Zotto, addressed to the prefecture of Messinia, in which "we communicate that with Council Resolution n.131 of 29/11/2010 were canceled in all actions and self-protection measures relating to the granting of the integrated water service of the municipality of Lipari ", including the same Council Resolution No 70 of 06/08/2009, pursuant to art. 21 h of L. No 241/1990 and subsequent amendments.
It 'clear that the City Administration had tried for the umpteenth time, to bypass those that are the prerogatives of the City Council on a matter so important that where, among other things, the City Council had already expressed, odg through May 2009, will manage the service in-house or through a company with public majority.
As the old saying "there are none so deaf as those who do not want to hear" ... .... , Though in the end, thanks to the strip of democracy and justice that still survives, this time were forced to open their ears. Carry
